SC agrees to examine the constitutional validity of the Election Commission’s delimitation  India News
New Delhi: The Supreme Court Monday agreed to examine the constitutional validity of Section 8A of the Representation of the People Act, 1950, which empowers the Election Commission to take limitations Constituency

A bench of Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Mishra, however, refused to stay the ongoing delimitation of Lok Sabha and Assembly seats in Assam by the Election Commission and sought the response of the Center and the poll panel on a batch of petitions in this regard.

The apex court sought the reply within three weeks and said the petitioners can file their reply within two weeks thereafter.
Ten leaders representing Assam’s nine opposition parties—Congress, Raijor Dal, Assam National Council, CPI(M), CPI, TMC, NCP, RJD, and Achalik Gana Morcha—recently filed a petition in the apex court challenging the ongoing demarcation process.
Two more applications in this regard are pending before the court.
The petitioners have specifically challenged the procedure adopted by the Selection Panel and the proposals notified on June 20, 2023.
